1. Scope of Application
These Terms and Conditions govern all contracts concluded between KC-ToThePoint (hereinafter “Provider”) and the customer for the use of the online learning platform academy.kc-tothepoint.com.
A consumer within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed in nature.
A business customer within the meaning of these Terms is any natural or legal person or partnership acting in the exercise of their commercial or self-employed professional activity at the time of concluding the contract.
Conflicting or supplementary terms and conditions of the customer shall not become part of the contract unless the Provider expressly agrees to their validity in writing.
2. Conclusion of Contract
The presentation of products and courses on the platform does not constitute a legally binding offer but an invitation to submit an offer.
By clicking the “Buy Now” or “Place Order” button, the customer submits a binding offer to purchase the selected course.
The Provider will confirm receipt of the order promptly by email. This confirmation of receipt does not yet constitute acceptance of the offer.
The contract is concluded when the Provider expressly accepts the order or grants the customer access to the purchased course.
3. Prices and Payment
All prices shown are final prices in euros and include applicable VAT where required by law.
Payment is due in advance. Access to the course will be activated only after receipt of full payment.
Available payment methods are displayed on the checkout page. iDEAL is available for customers in the Netherlands; additional international payment methods are available for customers in other countries.
The Provider reserves the right to change prices at any time. The price displayed at the time of ordering applies to the customer.
4. Access to Digital Content
Following receipt of full payment, the customer will receive immediate access to the purchased digital course content via their personal account.
Access is personal and non-transferable. Sharing login credentials with third parties is not permitted.
The Provider endeavours to maintain continuous platform availability but does not guarantee uninterrupted access. Scheduled maintenance will be announced in advance where possible.
5. Right of Withdrawal
5.1 Right of withdrawal for consumers
Consumers generally have a right of withdrawal in accordance with applicable law.

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract.
To exercise your right of withdrawal, you must inform us (KC-ToThePoint, C.F. Smeetslaan 147, 1901 GL Castricum, The Netherlands, email: info@kc-tothepoint.com) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email).
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.
5.2 Expiry of the right of withdrawal for digital content
The right of withdrawal expires in the case of a contract for the supply of digital content not supplied on a tangible medium where the Provider has begun performance of the contract after the consumer has:
- given express consent to the Provider beginning performance before the end of the withdrawal period, and
- acknowledged that they thereby lose their right of withdrawal.
This is in accordance with applicable EU consumer protection law (Directive 2011/83/EU, as implemented in national law). The consumer confirms these conditions during the ordering process by ticking the relevant checkbox.
5.3 No right of withdrawal for business customers
Business customers acting in the exercise of their commercial or professional activity do not have a statutory right of withdrawal.
6. Liability
The Provider is liable without limitation for damages arising from injury to life, body or health, and for damages caused by intentional or grossly negligent breach of duty by the Provider or its agents.
For slightly negligent breaches of material contractual obligations (cardinal obligations), the Provider’s liability is limited in amount to the foreseeable, contract-typical damage at the time of conclusion of the contract.
Any further liability of the Provider for slightly negligently caused damages is excluded.
The above limitations of liability do not apply to claims under the Product Liability Act or in the case of fraudulently concealed defects.
7. Intellectual Property and Licence
All course content, texts, videos, graphics and other materials on the platform are protected by copyright. The copyright belongs to the Provider or the respective rights holders.
By purchasing a course, the customer receives a simple, non-transferable licence for personal, non-commercial use.
Downloading, copying, reproducing, distributing or making course content publicly available without the express written permission of the Provider is not permitted.
The Provider reserves the right to claim damages in the event of infringement of these provisions.
8. Data Protection
The Provider processes the customer’s personal data exclusively for the purpose of fulfilling the contract and in accordance with applicable data protection law, in particular the General Data Protection Regulation (GDPR).

9. Governing Law and Jurisdiction
All legal relations between the Provider and the customer are governed by the law of the Kingdom of the Netherlands, to the extent permitted by law.
For consumers: this choice of law does not deprive the consumer of the protection afforded by provisions that cannot be derogated from by agreement under the law of the country where the consumer has their habitual residence (Article 6(2) Rome I Regulation). Consumers in EU member states therefore retain the mandatory protections of their national law.
For business customers: the exclusive place of jurisdiction is the registered office of the Provider in Castricum, the Netherlands, provided the customer has no general place of jurisdiction in the Netherlands.
10. Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR) at: https://ec.europa.eu/consumers/odr
The Provider is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
11. Severability
Should any provision of these Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by the valid provision that comes closest to the economic purpose of the invalid provision.
